Terms of Service

1. Agreement

By using the services provided by ADV IT Performance Corp ("ADV Strategy Pro," "we," "us"), you agree to these Terms of Service. If you do not agree, do not use our services.

2. Services

We provide AI-powered marketing intelligence services. Prices, scope and delivery terms below are taken from our published commerce catalog and are the same on our pricing page, in llms.txt and in ai-catalog.json:

• Free On-Page Readiness Guide — a guide, not an automated scanner: no score, no audit results and no competitor analysis. An automated on-page scanner is in development.
• Search Opportunity Action Plan ($197)
• Search-to-Sale Landing Page ($697) — 1 page
• AI-Native Revenue Website ($2,497) — 7 to 30 pages
• AI-Native GTM System ($4,997) — 20 to 160+ pages
• Enterprise Custom Infrastructure (from $10,000) — 100 to 1,000+ pages
• AIO Maintenance ($1,497/mo)
• Google Ads Management ($1,497/mo)
• Growth Operations ($1,997/mo) — 4 to 8 pages per month

3. Delivery

Each service has its own delivery term, and the delivery clock starts only when the start condition below is met (not at payment). Deliverables are generated by our AI-powered research pipeline and reviewed before delivery.

• Search Opportunity Action Plan: 48 hours after receipt of the onboarding questionnaire and competitor URLs
• Search-to-Sale Landing Page: 72 hours after approved brief and required assets
• AI-Native Revenue Website: 7 business days after approved site architecture and page allocation plan
• AI-Native GTM System: 3 weeks after approved full programmatic data schema and product catalog
• Enterprise Custom Infrastructure: Custom scope after scoping call and signed statement of work
• AIO Maintenance: Ongoing monthly service after account setup
• Google Ads Management: Ongoing monthly service after account setup and Google Ads access
• Growth Operations: Ongoing monthly service after account setup and access to Google Ads and GA4 properties

All deliverables are provided in digital format (deployed web pages, code repositories, or structured data). No physical goods are shipped.

4. Payment

• All prices are in USD unless otherwise stated
• Payment is processed securely via Stripe
• One-time payments are charged at the time of purchase
• We accept all major credit/debit cards

5. Refund Policy

Because our services involve immediate research execution, engineering deployment, and digital asset allocation, we operate under the following refund policy:

• Before work begins: Full refund available within 1 hour of purchase if project onboarding and research processing have not started.
• After work begins: No refund, as custom digital work and computational research resources have been committed. We will work with you to address any quality concerns with the deliverables.
• Free On-Page Readiness Guide: No charge, no refund applicable

To request a refund, contact contact@adv-it-performance.ca within 1 hour of purchase.

6. Intellectual Property

Upon full payment, you receive a perpetual, non-exclusive license to use all deliverables for your business purposes. This includes reports, strategies, content, and deployed landing pages.

You may not resell, redistribute, or white-label the deliverables without a separate partnership agreement.

The underlying AI systems, pipeline architecture, and our methodologies remain the intellectual property of ADV IT Performance Corp.

7. Data & Accuracy

Our reports are generated using AI-powered research grounded in real-time data scraping and verified competitor analysis. However:

• Market data and competitor analysis are based on publicly available information
• AI-generated insights should be validated against your internal business knowledge
• We mark unverified claims with [NEEDS VERIFICATION] tags
• We do not guarantee specific business outcomes or revenue figures

8. Limitation of Liability

ADV IT Performance Corp provides marketing intelligence and infrastructure services on an "as-is" basis. We are not liable for business decisions made based on our reports, lost profits, or indirect damages. Our total liability is limited to the amount paid for the specific service in question.

9. Acceptable Use

You agree not to:

• Submit fraudulent, misleading, or malicious data to our systems
• Attempt to reverse-engineer our AI pipeline or our processes
• Use our services for illegal purposes or to harm competitors through deception
• Overwhelm our systems with automated requests (rate limits apply)

10. Governing Law

These terms are governed by the laws of the Province of Ontario, Canada. Any disputes will be resolved in the courts of Ontario, Canada.

11. Changes

We may update these terms from time to time. Continued use of our services after changes constitutes acceptance. Significant changes will be communicated via email.
